VA Loan Denials Due to HOA Rental Restrictions:
Earlier this year at one of our Government Affairs Advisory Council Meetings, Vicki Frye mentioned that she has experienced a Sun City West VA purchase fall out of escrow because the VA loan was denied. It was denied because of the HOA rental restrictions.
This brought up an issue some agents, property owners and buyers may not be aware of, VA underwriting rules regarding HOA rental restrictions.
According to section 36.4363c6, there can be no prohibition or restriction on an owner’s right to lease his or her unit. There are some acceptable restrictions: a requirement that leases have a minimum 1-year term and community age restrictions are two of those restrictions.
Obviously, the age restriction was in place and that was fine, but the HOA also had a rental restriction in its governing documents of no lease could be longer than 6 months. And it is that restriction which led to the VA loan denial and in fact a mention that the entire HOA was not VA approved.

Maricopa County Elections:
In October 2018, WeMAR hosted Maricopa County Supervisors Clint Hickman and Steve Gallardo. We discussed many topics, but top of mind was elections issues. The Supervisors discussed the election audit, the Board’s record funding for elections, the use of tablets and other technology used in elections.
Supervisor Gallardo had previously worked as part of the Maricopa County election staff under Helen Purcell and was able to give us insight into the processes. You can watch the video of Coffee with the County Board of Supervisors at www.wemargad.org.
On June 26th 2019, the Maricopa County Board of Supervisor approved some dramatic changes to the way elections will be run going forward.
The most dramatic change will be the new post of Director of Election Day and Emergency Voting Procedures. This director will report directly to the Board of Supervisors, not Adrian Fontes Maricopa County Recorder.
Supervisors Gallardo and Gates headed a working group earlier this year dedicated to finding a way to make elections go smoothly without long lines and ballet issues.
