Arizona State Legislature – Jan 26, 2020 Update

The 2020 Legislative Session began on January 13th and since that time a lot of bills that have been introduced.

Here is a quick overview on some of the bills I thought members would be interested in seeing. You can always go to the the Arizona State Legislature website to see all the bills and their progress.

House Bills:
HB 2007 – Schools; tuition non residents
Provides that children of non Arizona residents may be admitted to public universities upon payment of tuition set by the governing board.

HB 2010 – personal financial course; requirement appropriation
Mandates that high schools provide a personal finance course that qualifies as a math class graduation requirement.

HB 2023 – Schools; budget format
Provides that school districts provide full time salaried employee pay and average regular class size on their website.

HB 2054 – GRRC : Petition to request review
Provides that the a person may petition the GRRC to review a practice or rule of a state agency.

HB 2088 – State Lake improvement fund appropriation

HB 2092/SB 1046 – Federal Government; land acquisition consent
States that the express consent of the Governor and Legislature must be given before private land can be sold, gifted or transferred to the Federal government.

HB 2184 – Occupational license notice
Provides all regulating agencies print a particular statement on websites, letters, notices and license applications.

HB 2288 – State licensing fee waiver; Active duty military, spouse and veterans
Provides that licensing fees be waived for active duty military, their spouse and veterans.

HB 2309 – Groundwater, water logged area exemption – Buckeye

HB 2312 – Financial Institutions; licenses
Revokes some fees, notice to Department of Financial Institutions of some license revocations, and display the license.Requires mortgage brokers, mortgage bankers and lenders of money to employee sponsorship requests to Nationwide Multistate Licensing System. Other provisions.

HB 2348 – city TPT; residential rentals limit
Limits any new or increased TPT tax rate to not more than 5% by a city or town.

HB 2351/SB 1129 – unlicensed real estate employee able to accept rent payment
Allows an unlicensed employee of a real estate broker, cemetery broker or camping membership broker to accept rent payments as part of their clerical duties. This is an AR support bill.

HB 2352 – Centrally assessed property; valuation pipelines
Allows pipeline properties base value to be adjusted to reflect the market value.

HB 2355 – Charitable contribution; deduction inflation adjustment
Allows the 25% charitable deduction to be indexed to the Phoenix Metropolitan CPI.

HB 2356 – Charitable contributions; deduction increase
Allows and increase from 25% to 50% charitable contribution deduction for taxpayers not itemizing.

HB 2359 – License denial prohibition drug convictions
Provides that occupational licenses cannot be denied of a person has been convicted of a drug crime under Criminal Code Title 13, Chapter 34 or 34.1.

HB 2455 – air quality omnibus
Changes air quality emissions fees and rules for auto emissions and testing.

HB 2671 – Water supply development fund; appropriation

Senate Bills:
SB 1001 – HOA payment books
Provides HOAs may send an owner a statement rather than a booklet.

SB 1003 – Auto title loans; clear title
Provides that auto title loans can only be placed on autos with clear title.

SB 1006 – special taxing districts lobbying prohibited
Provides that special taxing districts may not hire a lobbyist.

SB 1007 – multi purpose facilities district debt prohibition
Establishes that facilities districts cannot incur new long term debt.

SB 1008 – Multipurpose facilities districts, JCCR review
Provides that facilities districts submit projects for review by the JCCR if they cost more than $100,000.

SB 1009 – Multipurpose facilities districts; reports
Provides that facilities districts submit for review any real estate maintenance or construction in excess of $500,000.

SB 1016 – TPT on medical marijuana
Creates a TPT classification for non profit medical marijuana sales.

SB 1019 – Prohibition on regulation by locals on industrial hemp sites
Provides that no city, town or county can regulate or restrict any industrial marijuana facility.

SB 1021 – Department of Revenue; electronic signatures
Allows electronic signature be accepted by the Department of Revenue on any form. AR supports this bill.

SB 1036 – empowerment scholarships; third party administrator repeal
Removes requirement that Department of Education must contract with third party to administer Empowerment Scholarship Accounts.

SB 1039 – Home service warranty contracts
Makes changes to provisions of home warranty service contracts and expands definition of “consumer product” to anything becomes part of the usefulness of the real property and is transferred with the property as a function utility or system.

SB 1046 – Prohibit federal land acquisition
Prohibits transfers or sale of privately held land to the Federal Government unless the Governor and Legislature consent.

SB 1059 – TPT tax use for education
Provides for distribution of TPT tax (up to 1%) to schools for specific purposes.

SB 1068 – election and ethics; commission duties
Provides for the creation of an elections ethics committee.

SB 1071 – immigration; law enforcement; repeal
Repeals several provisions including employer entrapment parameters.

SB 1096 – Property management records
Makes changes to required tenant forms a property manager must keep and defines “related documents” that must be kep.

SB 1101 – appropriation north loop 101 interchange

SB 1124 – Commerce Authority; Data center equipment

SB 1153 – Appropriation Gila River Bridge

SB 1154 – Appropriation Queen Creek Rd Interchange @ I-10

SB 1155 – Appropriation Salt River Bridge @ I-10

SB 1156 – Appropriation I-10 Verrado Way to Miller Rd

SB 1157 – Appropriation State Route 101 widening from 75th Ave to I-17

SB 1159 – Appropriation Wild Horse Pass Interchange – change to diverging diamond

SB 1160 – Firefighter/Police Officer; Cancer presumption worker’s comp
Presumes ovarian cancer or breast cancer are work related if contracted by a firefighter or police officer.

SB 1162 – Registrar of Contractors – changes to licensing rules/qualifications
Makes changes to exams and qualifications to obtain a Contractors License.

SB 1168 – Nursing Shortage workgroup – pilot program
Establishes a workgroup to investigate program to encourage nurses and review curriculum.

SB 1202 – electric vehicle outlet reimbursement program
Provides homeowners who install a high voltage electical outlet to charge an electric car with reimbursement.

SB 1207 – State Land partial tracts patents
Allows State Land Patent on small parcels.

SB 1210 – Assisted Living caregiver training
Mandates requirements to become an assisted living facility caregiver.
