Proposed Peoria Sign Ordinance

Peoria Sports Complex

I was fortunate to attend a stakeholder meeting regarding the Peoria Sign Code Modernization Draft 11 21 (2).

Melissa Sigmund, Principal Planner at the City of Peoria, is heading the sign ordinance team.

Those of you who are brokers or represent commercial clients, I am concerned with the commercial sign sizes. They appear to be much too small, particularly if the signage is on a large parcel of land or a busy or fast moving street. Input you wish to give would be appreciated.

We are addressing the sign ordinance on two fronts: One is the constitutionality of the ordinance, the other is the practical implementation. We are questioning the necessity of sign permits since it appears to be an infringement of free speech as outlined by the Supreme Court. In addition, the code does not appear to serve a compelling government interest nor is it narrowly tailored.

While there are and will be constitutional issues, we need to give input so the ordinance that is finally approved is workable for our clients, ourselves and all business and property owners. The reality is members will most likely be operating under an ordinance that is unconstitutional, just as now. That won’t stop the City enforcement action, which is expensive and time consuming. My goal is to lessen those affects as much as possible. We do recognize the necessity of proper construction and maintenance, but those concerns are best addressed in the building/construction codes.
