ADA Lawsuits Target Valley Businesses

Arizona Attorney General Mark Brnovich

Arizona State Attorney General Mark Brnovich filed a motion on December 8, 2016 to dismiss over 1,000 ADA (Americans with Disabilities Act) lawsuits across the State of Arizona. The complaints all read the same and were filed against businesses for easily remedied problems like striping of a parking lot or a symbol on a sign.

Businesses and their real estate agents should be aware these types of lawsuits are on the rise and in this case, come from one individual who has filed over 1700 lawsuits. The goal? The Plaintiff sues and asks for $5,000 for what would cost a few hundred dollars to correct. He then offers to settle with the business. According to the Attorney General, the Plaintiff hasn’t patronized the businesses, ever.
